ACS Oregon Lawyer Chapter Hosts “Drawing a Line in the Sand: Property Rights, 'Judicial Takings' and the U.S. Supreme Court"

On November 12, 2009, approximately 30 ACS supporters attended a discussion of Stop the Beach Renourishment, Inc. v. Florida Department of Environmental Protection, a sleeper case where beachfront property owners are asking the U.S. Supreme Court to recognize a new doctrine of "judicial takings." They heard two competing views on the case, which involves possible new constitutional restrictions on states' ability to regulate the critical point where land meets sea, and a potential new level of federal scrutiny over the way state courts interpret state common law.
